Regarding display of photos that are in public domain?

I have uploaded an image into my Flickr

account and have diplayed the image publicly.

The image is more than 70 years old and hence

its term of copyright has expired.So at present the photo is in public

domain.Is my action appropriate.


A photo, not a picture out of a magazine or publication, is protected for the life of the photographer plus 70 years in the USA and EU countries. If the biographical info on the photographer is not available, you would need to wait at least 150 years before assuming to be public domain.

If it is a published item then different rules apply but it would still need to be more than 70 years old generally.

As long as there is no copyright held by another corporation or individual. I think I remember reading somewhere (but don't remember where) that a photo becomes public domain 50 years after the death of the photographer. Maybe someone can fill us both in.
