There is a period (usually about 3 months) when an expired domain name cannot be bought by anybody. In other words, the original owner can still register it again, but anybody else who tries to get it will simply go on a waiting list. When this protection period expires, the domain is dropped back on the open market and the people on the waiting list are notified.

Once it has expired, you can register for it. Unless it's parked or the domain owner has paid extra to keep it "safe" from being taken away.
